Mombasa: Man found guilty of defiling a 16-year-old girl

A Mombasa Court has found a man guilty of defiling a 16-year-old girl in Likoni.

George Odhiambo Owino, a Kenya Defence Forces (KDF) officer based at Mtongwe Naval Base, was accused of defiling the girl on diverse dates between July 3 and November 16, 2020.

The victim testified she was in Form Two when Owino, their neighbour, seduced her and promised her that if she agreed to be his girlfriend he would pay her school fees and other things she wanted.

She told the court that Owino went to their house where they had sex on her mother’s bed while she had gone to work and her siblings were out playing.

“She stated that they had sex four times in their home and later discovered that she was pregnant around August 2020,” court papers read.

The court heard that he used to send her younger children to their aunt and remain with the 16-year-old girl alone in the house before having sex with her.

He admitted responsibility for the pregnancy and the student gave birth in April 2021.

While he promised to take care of the victim, Owino only sent Ksh.10,000 and stopped, the court heard.

In his defence, Owino told the court that the girl had a big body.

“She told him that she had applied for an ID but it had not come out yet. He stated that the complainant used to do casual work for people and she used to ask him for help and he would offer her food,” the case files say.

The girl would also visit him at the barracks, cook for him and sleep there.

“They got used to each other and the complainant would go to his house and he asked her for a relationship. It was his defence that he didn’t know she was under 18 years old and he withdrew from the relationship,” read the documents

The man was found guilty of defilement, contrary to Section 8(1) as read with Section 8(4) of the Sexual Offences Act of 2006 and committing an indecent act with a child, contrary to Section 11(1) of the Sexual Offences Act.
