Meru: Man who defiled a disabled child twice sentenced to life imprisonment

A 58-year-old man who allegedly defiled a 12-year-old child with special needs, was arrested and released on bond then went ahead to defile her again, has now been found guilty of the heinous act and sentenced to life imprisonment.

Chuka Law Courts Resident Magistrate Oscar Chess Kinyua made the ruling on Tuesday after the prosecution proved the case beyond reasonable doubt.

The court heard that the accused defiled the same girl while out on bond for the initial defilement offence.

 

The prosecution team presented testimonies from four witnesses in the case, including a doctor as well as the investigating officer.

“Among the evidence produced were the birth certificate, P3 form, PRC form, treatment notes proving the age of the victim, and evidence of defilement,” the Office of the Director of Public Prosecutions (ODPP) said in a statement.

“After conviction, the Magistrate ordered that a pre-sentence report and the victim impact assessment report be filed. The victim is 12 years old with special needs living with her single mother, who also suffers from cerebral palsy.”
