Businessman Jimi Wanjigi has been released on a personal bond of Ksh10 million after being arrested and detained at Kamukunji Police Station on Monday.
Wanjigi appeared in court on Tuesday, where he was ordered to surrender his passport pending a ruling scheduled for September 12 on whether he will enter a plea.
On the same date, Wanjigi and the second suspect will find out whether or not the charges against them will be dismissed on September 12th, this year.
Earlier on Tuesday, Wanjigi's lawyers asked the court to postpone the plea.
Senior Counsel Paul Muite claimed that a prior court order barred the police from arresting Wanjigi.
He noted that the order also instructed the police to release Wanjigi if he had already been detained.
The lawyers also claimed that, in response to allegations of illegal firearm possession, the police acted maliciously and in contempt of court by cancelling Wanjigi's firearm licence, which had been reinstated by the High Court.
Lawyer Wallis Otieno added that the Firearm Licencing Board revoked Wanjigi's licence, which had been restored, in order to charge him with illegal firearm possession.
Otieno also contended before Presiding Magistrate Susan Shitubi that the charges against Wanjigi were fundamentally flawed, as the police had violated court orders by arresting him.
He also stated that Wanjigi was detained after voluntarily responding to a police summons to appear before DCI officers.
Otieno also claimed that the second accused, Kibe, was subjected to physical abuse by police, who allegedly caused pain by squeezing his genitals while in custody.
