
Jimi Wanjigi obtains court orders barring the police from accessing his residence

Businessman Jimi Wanjigi has obtained fresh orders barring police from accessing his premises.
This follows last Thursday’s raid at Wanjigi’s home in Muthaiga, where police claimed to have recovered four teargas canisters, two Motorola gadgets, seven assorted chargers for the pocket phone, and one mobile phone in a motor vehicle parked outside Wanjigi's gate.
While linking the businessman to the day’s ‘Nane Nane’ anti-government protests, the police also arrested two men allegedly carrying explosives while driving into Wanjigi's residence.
He then obtained a court order on Friday barring the police from arresting and detaining him, while the two men remain remanded after the court ruled on Monday that there are sufficient reasons to detain them pending investigations.
In subsequent orders issued later in the afternoon, the High Court in Nairobi certified as urgent Wanjigi’s new application against the office of the Directorate of Public Prosecutions (ODPP), barring police from accessing his residence.
“Pending the inter-partes hearing and determination of the Application dated 12/08/2024, a conservatory order be and is hereby issued restraining the Respondents jointly and severally, their officers, servants, agents, or third parties acting under the direction or authority of the Respondents from entering into or staying within the Petitioner/Applicant’s homes or business premises,
“Including the properties known as Muthaiga No. 44 and Kwacha House along General Mathenge Road in Nairobi City County; and if present within any of the Petitioner/Applicant's homes or business premises as at the date and time of this Court Order they are further ordered to immediately vacate the same,” read court papers.
The court directed that the authorities file and serve their responses to the Wanjigi’s application by close of business on Wednesday, August 14.
“The Petitioner/Applicant shall file a rejoinder, if needed, by close of business 15/08/2024. The Application dated 12/08/2024 shall be mentioned on 16/08/2024 to take a priority hearing date for the Application,” the High Court noted.
