A bench consisting of Justices David Majanja, Christine Meoli and Lawrence Mugambi is set to give a verdict on the petitions.
Various petitions were filed challenging the Act that came into force on July 1 before Justice Mugure Thande issued conservatory orders suspending its implementation.
The Finance Bill 2023 was passed by parliament on June 22, 2023, and later assented by President William Ruto on June 26.
The High Court would later suspend the implementation of the act on June 30, after multiple petitions were filed.
On July 29, the Court of Appeal lifted the suspension, leading to a hearing of the case on September 13.
Busia Senator Okiya Omtatah and six others moved to court seeking to stop the implementation of the Finance Act 2023.
Omtatah argued that the Finance Bill contains amendments to several laws that have nothing to do with raising revenue and laws that affect the work of the Senate to protect the interests of counties and their governments.
