High Court shuts down efforts of hotel linked to Alfred Mutua to gain access 3 bank accounts

High Court has declined an application to have a hotel associated with Tourism Cabinet Secretary Alfred Mutrua access three bank accounts to aid in operations.
The court had in September 2023 issued orders barring Mutua and one other co-director , Emily Chebet Loroupe from withdrawing , transferring ,depositing or dealing with the money held in three bank accounts belonging to hotel Brazillian Rodizio Limited located in Lavingtone, Nairobi County.
The hotel Brazillian Rodizio Limited filed an application seeking access the money in the the bank accounts opened so as to help in operations.
The hotel had argued that it will not be able to continue with its business operations and functions for the part of January, 2024, and from February, 2024 onwards, if it is not allowed to access its three bank accounts and withdraw funds to meet its expenses including operational costs, salaries, requisite statutory deductions, rent, utilities as well as the business premises insurance.
“The 3rd Defendant is the most affected by the ex-parte orders issued on September 15, 2023, restraining it or any of the other Defendants from withdrawing, transferring, disposing of and/ or dealing whatsoever with the money held in ***** (three bank accounts) because if it cannot access and withdraw the funds, then it cannot manage and operate its’ business functions including meeting its’ expenses and statutory requirements,” reads court papers.
In the case Ubhi Ripthuman Sighn moved to court accusing Alfred Mutua and Emily of mismanaging and sidelining him from decision making. He argued that he has reliably learnt that several dealing and transactions have been effected, and that that the transactions were never approved by him as a co-director.
Through lawyer Phillip Nyachoti, Sighn claims he has several times requested that he be provided with copies of various company documents relating to the financial year 29022/2023 but he has been ignored.
