A Nairobi court has granted the DPP permission to withdraw the Sh7.3 billion fraud case filed against Deputy President Rigathi Gachagua and nine others.
However, the court has warned the accused that if investigators find evidence, they may be arrested again on the same charges in the future. Gachagua's passport and the Sh12 million he had deposited in court in order to be released from police custody.
The court recommends that a law be enacted to create the office of a pre-trial judge who will check to see if there is enough evidence before any accused person is arraigned in court.
"It is unjust to subject judicial officers to lengthy notes when there is no case," said magistrate Victor Wakumile.
