Court allows Directors, teachers of Joy Gardens Primary school to access the school after mysterious death of Grade 8 student

Two directors and three teachers of Joy Garden Primary School who had been arrested following the death of a pupil can now access the school.

This is after the court varied its earlier orders which had blocked them from visiting or going near the institution located in Nairobi's Umoja-Tena area.

The five are Jane Waithera Kimani, James Mungai Gachimo, Caroline Nthio Matheka, Anthony Mwangi Kimani and Vanice Kerubo Bosire.

At the same time, the court will issue its ruling on whether Antony Mwangi Kimani will be given his passport to allow him to travel out of the jurisdiction. Kimani applied to have the passport released to travel to the UK.

However, the prosecution opposed the application saying that investigations are still ongoing and therefore the passport should not be released.

The five were arrested after a Grade 8 boy died mysteriously with the school claiming that he fell from the seventh floor of the building hosting the school. They are being represented by lawyer Danstan Omari

The family of Wesley Njiru has however disputed the school's claim that their son died as a result of a fall.
