Anne Waiguru drops defamation case against Google

Kirinyaga Governor Anne Waiguru has dropped a defamation suit against the global search engine, Google.

When the case came up for mention before Milimani High Court Judge Chacha Mwita on Tuesday, May 14, 2024, Waiguru made an oral application seeking to withdraw the defamation case against the internet giant Google, Google Kenya, and Kenya's Daily Post for an alleged defamatory story published about her while she was CS Devolution.

"We urge the court to allow our request to withdraw the lawsuit against Google as it has complied with our demands and they have pulled down the defamatory story that had been published against Governor Waiguru. We do not wish to proceed with the matter further," the county boss through her lawyer informed Justice Mwita.

Google, through lawyer Cecil Kuyo, did not object to the request by the county boss and confirmed they had settled the matter out of court.

Consequently, Judge Mwita allowed Governor Waiguru's request to withdraw the matter against the California-based Google.

"Let this matter close there and I mark this matter as closed and I make no orders to cost," Justice Mwita ordered.

Waiguru had sued the global internet giant Google Inc., and its subsidiary Blogger Inc. for the article alongside Kenyan website, The Daily Post, which authored the alleged defamatory story against her after a story was published during the sacking of the then Chairman of Youth Development Fund Gor Semelango.

In the lawsuit, Waiguru had claimed that the post published in May and April 2019 on Daily Post had caused her trauma and embarrassment.

She pointed out that the story which was on the World Wide Web has been used to bully her school-going children, and therefore immediate action ought to be taken.

Though Google in this case was only a carrier of the story after the story was published by the Daily Post.

In her lawsuit, she had sought compensation for damages and the content pulled down that had been published by a Kenyan blogger.
