No hope for Sonko as IEBC Invalidates Sonko's candidacy

The Independent Electoral and Boundaries Commission ( IEBC ) has nullified Mike Mbuvi's candidature for the Mombasa gubernaterial seat. As stated in Ibrahim Yusuf's letter, who is the returning officer in County 001, he tells Sonko that he was revoked from holding any public office and therefore cannot contest in the Mombasa governors seat or any other county.

IEBC Stated that,"the main reason as to why the High Court allowed his registration as a candidate was the presence of the appeal in the Supreme court and since Supreme Court is the highest in judicial hierachy there will be no other appeal. In addition IEBC said in adherence to the supreme court judgement. Mike Mbuvi is disqualified from contesting for Mombasa governor's seat. His candidature is invalidated and certificate revoked." 

Mike Mbuvi claimed that the Supreme Court had violated the Bangalore Principle of Impartiality which states that; Impartiality is essential to the proper discharge of the judicial office. It applies not only to the decision itself but also the process by which the decision is made. Application: 2.1 A judge shall perform his or her judicial duties without favour,bias or prejudice.

Sonko has decided to file a case at the East African Court Of Justice to appeal the Supreme Courts ruling saying that the ruling was unjust and violated his political rights and that of his supporters.
