Willy Paul cyber harassment case dropped by DPP

Singer Willy Paul has released a statement following the closure of the cyber-harassment case against him after the Office of the Director of Public Prosecutions (ODPP) determined that the evidence was illegally obtained.

In a letter shared on his social media, it read:

"The DPP reviewed the documentary evidence and the statements of the witnesses on record, along with the complainant's letter. From the evidence on record, we noted that the suspect's mobile phone was confiscated and analyzed by the Communication Authority of Kenya as per the Cyber Investigations Report dated December 21, 2021. However, we established that the forensic evidence was obtained without a court order. Article 31 of the Constitution provides for the right to privacy, which can only be limited by a court order. Therefore, the forensic evidence obtained was illegal and inadmissible. Based on the foregoing, we direct that the case be closed to avoid a miscarriage of justice."

Willy Paul also shared his own statement, expressing relief and frustration over the ordeal:

"I was once paraded online in a staged arrest from my home and taken to the police station with the intent of forcing me to take plea for a non-existent offense, driven by malice to humiliate me. The arrest resulted from baseless accusations meant to ruin my reputation. I was publicly demonized, mocked, and my name dragged through the mud without regard for the facts.

This isn’t the first time I’ve been maligned. You might remember the serious allegations made by Miss P, but two years later, she apologized publicly. Damage to one's reputation, especially for a public figure, can be very damaging.

I’m grateful to the ODPP for upholding justice and reviewing the case fairly. After evaluating the evidence, the DPP confirmed that it was illegally obtained and recommended the case be closed, as proceeding would have resulted in a miscarriage of justice.

Thank you to all my fans, supporters, and corporate partners for believing in me. Despite the cost and difficulty of these false allegations, I refuse to let them crush my spirit. I hope that one day the truth will be clear to everyone. As they say, the wheels of justice turn slowly, but they grind exceedingly fine."
