Nyandarua MCAs plan an impeachment motion against Governor Moses Ndirangu Badilisha

A member of the Nyandarua County Assembly has moved to court seeking the removal of Governor Moses Ndirangu Badilisha over an alleged violation of the constitution.

In the petition, MCA Samuel Wainaina argues that Governor Badilisha has breached the law in many instances and even acted in full contempt of county laws.

He says that the governor is "unethical, deplorable and reprehensible" and is "incompatible with the high calling and dignified status of the Office of the Governor of Nyandarua County".

 

Wainaina says that on or about September 5, 2024, Ndirangu through the County Executive Member for Finance, Economic Planning and ICT, allowed and oversaw the Deployment of the (Governor’s Service Delivery Unit - GSDU Officers) to head the seven revenue stations in the county contrary to the dictates of law.

"This can only be ill plans to defraud and misappropriate Revenues at Source and thereby negatively affecting service delivery to the public of Nyandarua County," reads the petition in part.

He also claims that the governor has illegally hired county staff who continue to draw salaries from the county coffers.

MCA Wainaina also claims that the Governor has breached Section 47A of the Anti-Corruption and Economic Crimes Act by engaging in corruption as he has demanded money from county service providers.

He says that the governor has subsequently failed to ensure that the services provided are not paid for on time, leading to a heaping of pending bills.

"The Governor introduced a pyrethrum program in the budget, where seedlings were procured at huge amounts of money, only to end up NOT growing. The said pyrethrum program was nothing but a scum to syphon public coffers for selfish and personal enrichment by public funds," he argued.

Wainaina also holds that the governor has contravened the Public Procurement and Asset Disposal Act by contracting his company to undertake a construction for the county which he says was subpar.

"The company did NOT undertake the works satisfactorily as the county public works did not certify some works for payment for falling short of Kenya building code & standards," he said.

He adds that Governor Badilisha has illegally awarded catering services to a hotel attached to him and allowed unchecked procurement deals to sail through the county funds office.

He therefore wants the County Assembly to embrace his ouster motion against the governor, calling him "a ticking time bomb to the extent that it has the potential to plunge the County into economic turmoil and development backwardness."
