Businessman Cleophas Shimanyula barred from defaming Boni Khalwale or his family members

Businessman Cleophas Shimanyula aka Toto has been barred from posting on any electronic or print media, internet, digital web page and/or in any media platform or any other platform wheresoever or publishing or disseminating any manner whatsoever the defamatory words, statements against Kakamega senator Boni Khalwale, his family and the family of Late Kizito Moi Amukune.

The order will be in place pending a case where the Kakamega Senator has sued Toto for defamation. 

“Pending the inter-partes hearing and determination of this application, this honourable court be pleased to issue a temporary injunction restraining the defendant either by themselves, legal representatives, their servants, agents or anyone acting under their authority from or content or any similar words or statements or content of like effect arising from or relating to the Applicant, his family and/or his former employee, the Late Kizito Moi Amukune," reads the order. 

In the suit Khalwale demands Ksh.800 million to be shared between himself and his three wives and an additional Sh500 million for his 17 children.

Through his lawyers Danstan Omari and Shadrach Wambui, had earlier wrote to Toto, demanding that he retracts a statement against him within 48 hours.

The Senator proceeded to file another suit after the businessman failed to retract the statement, where he (Toto) had linked Khalwale to the death of his farmhand, Kizito Moi. 

A postmortem report by Chief Government Pathologist Johansen Oduor revealed that Moi succumbed to injuries inflicted by Khalwale’s bull.
