Kisumu: Man given a death penalty for stealing and using drugs to incapacitate the victim

A Kisumu man has been handed a death sentence after being found guilty of robbery with violence and using drugs to stupefy his would-be victim.

Kevin Onyango Kiyogo reportedly committed the offences on June 23, 2023 at Kogutu in Muhoroni, Kisumu County.

"The accused was charged with two counts of robbery with violence contrary to section 296(2) of the Penal Code and stupefying in order to commit a felony contrary to section 230 of the Penal Code," said the Office of the Directorate of Public Prosecutions (ODPP) in a statement.

During the incident, an armed Kiyogo allegedly used violence to steal a Toyota Hilux vehicle, valued at Ksh.1.8 million, from one James Kamau, whom he had reportedly incapacitated with drugs.

 

The prosecution team presented 8 witnesses before Tamu Law Courts Senior Principal Magistrate Amos Mokoross to testify on the matter.

"The court noted that all exhibits and testimonies drove to the conclusion that the accused person jointly with others not before the court indeed committed the offence on the complainant," said the ODPP.

"In his judgement, the magistrate sentenced the accused person in the first count of robbery with violence to serve a death sentence and in the second count of administering an overpowering drug to the complainant, the accused person will serve five years imprisonment."

The death sentence will be held in abeyance until the completion of the five-year sentence.
