Kawira Mwangaza seeks court orders to continue serving as Meru county Governor

Embattled Governor Kawira Mwangaza has pleaded with the court to grant her orders allowing her to continue serving the people of Meru County.
During a hearing before Justice Bahati Mwamuye on Tuesday, Mwangaza’s lawyers, Elius Mutuma and Elisha Ongoya, argued that the governor would suffer prejudice if the conservatory orders are not granted.
They contended that Mwangaza was not accorded a fair hearing during her impeachment, adding that the proceedings from the Meru County Assembly forwarded to the National Assembly were null and void.
Regarding the conservatory orders, lawyer Elius Mutuma asserted that Mwangaza has a prima facie case with a likelihood of success, and that without these orders, she is likely to suffer prejudice.
Mutuma further argued that if the orders are not granted, the petition will be rendered nugatory.
“We have a case that has overwhelming chances of success, and we have substantial material that demonstrates the strength of the petitioner's case,” the court was told.
Mutuma noted, “The governor was previously dragged into similar charges last year and was acquitted. The Senate failed to recognize that bringing similar charges again is in contravention of the law. How will justice be served?”
On its part, the Senate urged the court to dismiss the application, arguing that there were no orders stopping the impeachment process.
The matter will be mentioned next Tuesday to set a date for a ruling. The Senate seeks to vacate any orders barring Mwangaza from vacating office pending the hearing of the petition.
