The Katiba Institute has lodged a new petition challenging the legality of the government's partnership with Adani to manage Jomo Kenyatta International Airport (JKIA) and a major electricity transmission project.

This is the most recent petition against the deal, which has already faced multiple suits questioning its constitutionality.

Unlike previous petitions, which focus on specific procedural issues, the Katiba Institute's case challenges the constitutionality of the entire Public Private Partnership (PPP) Act of 2021.

According to court documents, Katiba claims that the Act, which approved the Adani deal, undermines Kenya's constitutional framework by omitting critical parliamentary oversight and approval processes.

 "Both these projects have been concluded under the Public Private Partnership Act 2021, whose provisions undermine the constitutional framework for checks and balances by excluding parliamentary approval and oversight,” the institute stated in its filings.

Katiba Institute is seeking an injunction to prevent the government from moving forward with the Adani concession agreements.

The institute contends that without adequate legislative oversight, the agreements risk jeopardising transparency and accountability in the management of critical public infrastructure.

The High Court is expected to set a date for the hearing of Katiba's petition, which could further delay or even halt the execution of the contentious agreements.
