The Ethics and Anti-Corruption Commission (EACC) has taken legal action by filing a lawsuit against an Energy Company over a parcel of land purportedly belonging to the Kenya Railway Corporation.
Additionally, the Neno Evangelism Centre church, owned by Pastor Ng’ang’a, which is situated on the disputed land, has been implicated in the case.
Furthermore, the Commission has brought the former land officials, who held office during the period from 1975 to 1999 when the land was allocated to private developers, into the lawsuit.
According to the suit papers, EACC alleged that a former physical planning director in the Ministry of Lands was also involved in the land commissioning.
The case was presented before an Environment and Land Court in Nairobi which also noted that the land situated along the Uhuru Highway, was reserved to decongest Nairobi traffic.
"EACC contends that the property was land alienated for public utilities and therefore was not available for allocation,” EACC noted.
“Therefore, the purported alienation and creation of LR No. 209/9641 and LR No. 209/12133 by the defendants was fraudulent, illegal, null and void.”
This comes after Thika town Member of Parliament (MP) raised alarm over private developers plotting to grab land belonging to the Ministry of Public Works.
According to the legislator, two alleged land grabbers filed a case at the court to sue the government, claiming ownership of the contested parcel along the Thika-Garissa Highway.
“The people who were born and raised in Thika, we have always known this place to be known as MOW. Even the property that is here belongs to the ministry,” Ng’ang’a stated.
Ng'ang'a has also called for a thorough investigation to be conducted to uncover the Ministry of Lands’ officials who were implicated in leasing the land to the two developers. These developers are now seeking compensation for the land in question.
“These two gentlemen have taken us to court, telling us we need to vacate from their land. They are stealing in broad daylight and they have not been arrested,” the MP noted.
