Court Declines to Overturn Former Governor Waititu's 12-Year Imprisonment

Former Kiambu Governor Ferdinand Waititu has suffered yet another setback after the High Court declined to overturn his 12-year imprisonment over Ksh588 million graft case.
In the ruling delivered on Tuesday, September 16, Lady Justice Lucy Njuguna rejected an application filed on August 28, 2025, in which the former county boss sought to overturn his sentence.
The court ruled in favour of the Director of Public Prosecutions (DPP), who opposed Waititu's release, arguing that the former Governor's appeal lacked proper grounds.
The ruling comes a month after the former Governor was freed on a Ksh53 million bond pending the hearing and determination of his appeal, which sought the dismissal of his imprisonment.
Waititu, in his appeal, claimed that the trial court had erred in law and fact in reaching its verdict. He was released on bond terms, allowing him to remain out of prison as he pursues an appeal against his conviction.
However, the latest ruling means that Waititu will continue serving his term at Kamiti Maximum Prison. He had failed to meet strict bond terms that required him to deposit a Ksh53 million bank guarantee.
Meanwhile, in February this year, Waititu was sentenced to a 12-year' imprisonment and ordered to either pay a fine of Ksh53.5 million .
This was after the court found that he failed to uphold the principles of good governance and safeguard public funds after irregularly receiving Ksh25 million following the award of a flawed tender.

Besides the 12-year imprisonment, the former Governor was also barred from holding public office for a period of 10 years.
The Milimani Anti-Graft Court Chief Magistrate Thomas Nzioki also directed that Waititu's wife, Susan Wangare, pay a fine of half a million or serve a sentence of one year in prison.
The Chief Magistrate further revealed that Waititu's conduct could not be forgiven since his actions undermined the tenets of good governance.
The former Kiambu Governor has been having run-ins with the prosecutorial agencies over graft allegations since his exit from office in 2019.
