Boni Khalwale demands KSH 200 million compensation from Cleophas Shimanyula for defamation remarks against him

Kakamega Senator Boni Khalwale has given businessman Cleophas Shimanyula aka Toto to pay him Sh200 million as compensation for alleged defamation remarks he made against him.

The Senator has also issued a 48-hour ultimatum to the tycoon to apologize for the alleged defamatory remarks he has made against him.

Through his advocate Danstan Omari, Khalwale has demanded that Cleophas write to them within the next 48 hours stating that he will immediately publish an apology and retract the statements he made regarding the death of his farmhand Moi Kizito.

“We demand from you, that you confirm to us in writing, within the next 48 hours that you shall immediately compensate our client Sh200 million for damaging his reputation and accept liability for defamatory statements published in the article” reads the demand letter in part.

Khalewale says he will move to court and institute legal proceedings if Cleophas fails to fulfil the demand.

The Senator says following the defamatory remarks, he has been the subject of spite, and public hatred and is now treated with suspicion by many County and National government officials as well as individuals and groups that previously respected and regarded him highly.

“It is clear from the totality of the foregoing that the overarching objective was to create malicious falsehoods aimed at maligning Our Client to deviously orchestrate his removal from office and or his wrongful arrest and prosecution for the untimely death of his employee,” reads the letter.

Omari said the unfair treatment of our Client can no longer be trivialized, or placed beyond remedy.

Khalwale's farmhand Kizito Moi’s remains were discovered on January 28 at Khalwale's shed lying in a pool of blood and mud.

He worked for him for two decades.
